Capitol Records and Universal Publishing sued Monster Energy Drinks Wednesday, saying the beverage company’s use of an assortment of Beastie Boys songs in an online advertisement without permission constituted a violation of copyright.
In June Adam “Ad-Rock” Horovitz and Michael “Mike D” Diamond — the two remaining Beastie Boys — won a $1.7 million copyright infringement lawsuit against Monster for the same ad.
Now, Capitol and Universal, co-owners of the copyright, want to get paid for the infringement as well.
Monster Energy Drinks is accused of violating the copyrights of Beastie Boys songs.
“Monster’s infringing acts were willful, intentional and purposeful, in blatant disregard of Plaintiffs’ rights,” court documents filed in Manhattan Federal Court read.
The montage of Beastie Boy hits was posted on YouTube and Facebook after Adam “MCA” Yauch’s death in May 2012. It concluded with the words “RIP MCA,” some of them in Monster green.
The Beastie Boys have long declined to license their music for use in ads — a practice Yauch requested continue in his will.
